Arbitration with Killerspin

Dear Members:

On the advice of USATT's general counsel, USATT is able to share the following information about this matter.

In January 2004, the Board of Directors of USA Table Tennis entered into a contract with Killerspin, LLC under which Killerspin acquired the rights to the title sponsorship of the 2004, 2005, and 2006 US Opens.  The contract was a result of protracted negotiations.  The contract included language that clearly delineated the responsibilities and obligations of both parties.  USATT regrets that it is now forced to invoke the contract's arbitration clause to compel Killerspin to satisfy the obligations Killerspin committed to perform.

Under USATT's rules, motions considered by the Board of Directors must be made public following the conclusion of voting.  That responsibility was fulfilled.  USATT will vigorously pursue enforcement of the sponsorship contract with Killerspin.  No Director or staff member of USATT will engage in public debate regarding the merit of this matter before the conclusion of the arbitration process unless advised to do so by USATT's general counsel.
