Re: truth of recent allegations against Kuhlmann in regards to copyright

Some people seem to be interested in hanging out some dirty laundry on the internet...especially when they think that the washing machine is not connected to the net (this would help to let it smell bad much longer).

On 11/17/94 there was a message on the Space Music list:

> Subject: kdm comments about KS (2nd installment)
> STEVE BACHINI: The often mentioned "Fax" label is obscure, but not ZYX.
>Atleast ZYX are paying the COPYRIGHT SOCIETY, what this Mr. Kuhlmann avoids to
>do (which is, frankly spoken: a crime). Besides, he uses a fake LC-number
>(which is, as the appropriate German society GVL told me, also a crime).
Before too many messages will blow up this list re this subject I would like to provide you with some "first hand" information...

Yes, I don't pay the German copyright society GEMA...(oh my God a crime !) NOT AT ALL !!! ...because on my behalf a man named Michael Zosel (MZ) in Bad Kreuznach/Germany does it since I started the label. From the start (PK 08/16 "True Colours" 12") my records had a LC-number -LC 6269- (this Labelcode of the GVL is mainly important for labels to have airplay in Germany...no LC-number...no airplay, as simple as that). This LC 6269 is owned by MZ as well. FAX is handled as one of his sublabels.

For those who still don't know what FAX is about:

  1. INNOVATIVE ENVIRONMENTAL/AMBIENT MUSIC
which all the major- and independent labels found boring when I asked them if they would release "SILENCE" (by Dr.Atmo and me) in September 1992. I was scared to release it as the costs for pressing 500 items were very high referred to the money I had at that time. By then I even had NOBODY who wanted to distribute it. After some time I was able to convince my worldwide distributor NEWS in Gent/Belgium to release the CD in Winter 1992.

  2. SOCIAL RESPONSIBILITY TOWARDS THE ARTISTS
a label provides a service...the service to release and to distribute the records AND to cash the money from the distributors. All of this has to be done in favour of the artist in the first place. FAX is very well known to keep costs low and to pay the major amount of the profit to the artists who created the music. The money is paid immediately after FAX received it from the distributors (4-8 weeks after release). The average amount per CD for an artist on FAX is DEM 5,-- (PS-Sublabel). PK-, PW-, AW- and YT-releases are composed in collaboration with me, so 10 per cent from the plain profit goes into labelwork and 90% of the profit are being split (45/45) between the collaborator and me. Profit is defined by plain manufacturing costs deducted from the income.

  3. THE GLOBAL ENHANCEMENT OF THE ENVIRONMENTAL/AMBIENT MOVEMENT
through collaborations on the PW-"FAX-Worldlabel" and the worldwide distribution of all FAX related labels we have more and more success to turn this music into a worldwide movement.
Sorry for this lenghty message but I hope it helps to clarify some points re FAX business and music. I hope that there are no misunderstandings through my weird English sometimes (there was nobody here to check it today (chistmas eve)).

Merry X-mas and a healthy and successful year 1995.

Peter
